Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LuckyMeal websites, applications, and related services (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Who provides LuckyMeal
LuckyMeal is owned and operated by adler.studio, operated by adlerlagune OG ("LuckyMeal", "we", "us", or "our"). Our provider and contact details are available in our Imprint.
2. What the Services do
LuckyMeal helps people discover restaurants, dining experiences, promotions, and creator content. It also provides tools and application forms for restaurants and creators. Features may differ by location, device, or account type and may change as the Services develop.
Unless we expressly say otherwise at checkout or in a separate agreement, LuckyMeal is not the restaurant, seller of food, booking agent, or payment processor. Any purchase, booking, redemption, or other transaction with a restaurant or third party is between you and that third party.
3. Eligibility and accounts
You must have legal capacity to agree to these Terms. If you are a minor, you may use the Services only with the permission and supervision of a parent or legal guardian. If you use the Services on behalf of a business or organisation, you confirm that you have authority to bind it to these Terms.
You must provide accurate, current information, keep your login credentials secure, and promptly tell us if you suspect unauthorised access to your account. You are responsible for activity through your account unless it results from circumstances outside your reasonable control.
4. Restaurant information, offers, and redemptions
Restaurant details, opening hours, prices, availability, menus, promotions, and similar information may be supplied by restaurants, creators, or other third parties. We work to keep this information useful, but we cannot guarantee that it is always complete, accurate, or current. Confirm important details directly with the restaurant, including allergens, dietary requirements, accessibility, price, and availability.
Offers may have their own eligibility rules, redemption limits, locations, dates, and exclusions. Those offer-specific conditions form part of these Terms. Restaurants remain responsible for honouring their offers and providing their products and services. Nothing in these Terms limits rights you may have against a restaurant or other trader under applicable law.
5. Restaurant and creator applications
Submitting an application, joining a waitlist, receiving a referral link, or viewing an earnings estimate does not guarantee acceptance, placement, exclusivity, work, payment, or any particular result. If we accept you into a restaurant, creator, ambassador, referral, or similar programme, additional written terms may apply. Those additional terms will control if they conflict with these Terms.
6. Acceptable use
You must not:
- use the Services for unlawful, fraudulent, or deceptive activity;
- impersonate another person or misrepresent your identity, affiliation, audience, restaurant, offer, or content;
- interfere with the Services, bypass access or redemption controls, or probe or exploit security vulnerabilities;
- use automated means to scrape, copy, or access the Services except where we have expressly permitted it;
- upload malware or content that is illegal, infringing, threatening, hateful, or materially misleading; or
- misuse promotions, create duplicate accounts to avoid limits, or sell or transfer an account or redemption right without permission.
7. Your content
You retain ownership of content you submit to the Services. You confirm that you have the rights needed to submit it and that it does not violate law or another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, and display that content only as reasonably necessary to operate and improve the Services. We will seek separate permission before using your content in advertising outside the Services.
We may remove or restrict content where we reasonably believe it violates these Terms, applicable law, or the rights or safety of others.
8. Our intellectual property
The Services, including their software, design, branding, and original content, are owned by us or our licensors and are protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Services for their intended purpose. These Terms do not transfer any intellectual property rights to you.
9. Third-party services
The Services may link to or integrate maps, social networks, restaurants, app stores, and other third-party services. Their own terms and privacy practices apply to your use of them. We do not control and are not responsible for third-party services, but this does not affect any responsibility we have under mandatory law.
10. Privacy
Our Privacy Policy explains how we collect, use, and protect personal data when you use the Services.
11. Availability and changes to the Services
We aim to keep the Services available and secure, but we do not promise uninterrupted or error-free operation. We may maintain, update, add, or remove features. Where a change materially reduces a paid or ongoing consumer service, we will provide reasonable notice where practical and respect any rights required by law.
12. Suspension and termination
You may stop using the Services at any time and may close your account through the available account controls or by contacting us. We may restrict or suspend access where reasonably necessary to protect the Services or others, comply with law, investigate misuse, or address a material breach of these Terms. Where appropriate, we will give notice and an opportunity to remedy the issue.
13. Warranties and liability
The Services are provided with reasonable care and skill. To the extent permitted by law, we do not make guarantees beyond those expressly stated in these Terms, including about restaurant information, third-party conduct, or uninterrupted availability.
We are not liable for indirect or unforeseeable loss, or for loss caused by a restaurant, creator, other user, or third-party service outside our reasonable control. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for intent, gross negligence, death or personal injury, or your mandatory consumer rights.
14. Changes to these Terms
We may update these Terms to reflect changes to the Services, our business, or applicable law. We will post the updated Terms and revise the effective date. If a change materially affects your rights, we will provide reasonable advance notice where required or practical. Changes do not apply retroactively.
15. Governing law and disputes
These Terms are governed by Austrian law, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of the mandatory protections of the law of the country where you usually live. Consumers may bring claims before any court that has jurisdiction under applicable law. For business users, the competent courts in Vienna, Austria have exclusive jurisdiction to the extent permitted by law.

16. General
If any part of these Terms is found unenforceable, the remaining parts remain in effect. A delay in enforcing a right is not a waiver of that right. These Terms, together with any applicable additional terms, form the agreement between you and us regarding the Services.
